Title: LL&S Processing Facility and LL&S Construction and Demolition Debris Landfill Public Hearing on Through-put and Setback Waiver Applications
Description: The New Hampshire Department of Environmental Services, Waste Management Division (NHDES) has received both a Type I-A and a Type I-B Permit Modification Application, pursuant to RSA 149-M:9, from LL&S, Inc., whose mailing address is 89 Lowell Road, Salem, NH 03079. The Type IA application proposes to increase the throughput capacity of the LL&S, Inc. wood processing facility from 175,000 tons per year to 200,000 tons per year. The processing facility and an adjacent landfill are currently located within one contiguous solid waste facility boundary. The Type IA and Type IB applications propose to divide the wood processing facility and the landfill into two separate solid waste facility boundaries by adding a property line between these facilities. Neither facility would meet current solid waste setback requirements from the proposed new facility boundaries. The applicant has also submitted a request for waiver of Env-Sw 503.02(b), which requires a 50-foot setback from a processing and treatment facility to any property line, and a request for waiver of Env-Sw 804.04(a), which requires a 100-foot setback from the footprint of a landfill to a property line. The existing processing and treatment facility is currently operating under Standard Permit No. DES-SW-SP-94-002, and the existing closed landfill is maintained under Standard Permit No. DES-SW-TP-94-030, both issued by NHDES.
