Title: Negative Declaration for Oil and Natural Gas Control Techniques Guideline 
Description: Section 172(c)(1) of the Clean Air Act (CAA) provides that SIPs for nonattainment areas must include reasonably available control measures including reasonably available control technology (RACT), for existing sources of emissions. CAA Section 184(b) requires that states in Ozone Transport Region (OTR) must revise their SIPs to implement RACT with respect to all sources of VOC in the state covered by a CTG issued before or after November 15, 1990. CAA Section 184(a) establishes a single OTR comprised of the Consolidated Metropolitan Statistical Area that includes the District of Columbia and several northeast states, including New Hampshire. The existing rules establish requirements for the implementation of RACT on certain stationary sources located in New Hampshire that emit volatile organic compounds (VOCs), as required to comply with sections 172(c)(1) and 182(b)(2) of the CAA. VOCs can interact with nitrogen oxides to form ground-level ozone, which is one of the pollutants for which a National Ambient Air Quality Standard is established. The Department, in its August 2018 RACT certification submittal to the SIP, stated that the state did not have any sources to which the 2016 Oil and Natural Gas CTG applies. This statement represents a negative declaration.
